Iran rejects UN criticism of its cyber security rules

UNITED NATIONS (Reuters) - Iran rejected criticism from a U.N. human rights investigator over its tighter cyber security rules, saying they are necessary to protect it against cyber attacks and have nothing whatsoever to do with freedom of expression.

In his latest report, U.N. special rapporteur on the human rights situation in Iran, Ahmed Shaheed, said he was concerned about reports of government activities "that seemingly infringe on freedom of expression and the right to information."

He said authorities have reportedly targeted websites they see as promoting terrorism, espionage, and economic or social crimes.

These include sites that contain "pornographic content, insult Islam or Government officials, proselytize unrecognized religions, or establish anti-government political groups," Shaheed said.

In a response to his report, presented to U.N. General Assembly delegations this week and sent to Reuters on Thursday by Iran's U.N. mission, Tehran said its cyber policies were unrelated to human rights.

"Establishment of (a) cyber council for securing domestic Internet relates to security and sovereignty of states rather than an issue dealing with promotion and protection of human rights," the Iranian statement said.

"As a country frequently targeted by highly sophisticated vicious cyber attacks, often orchestrated by certain States, Iran has every right and reason to strengthen its cyber space security," the Iranian response said.

"Contrary to the report (and its) assessments based on overly misleading information, this has nothing to do with the freedom of expression at all."

STUXNET FALLOUT

The Islamic republic tightened cyber security after its nuclear program was attacked in 2010 by the Stuxnet computer worm, which caused centrifuges to fail at its main uranium enrichment facility.

Tehran, whose nuclear program is suspected by Western powers and their allies of developing the capacity to produce weapons, accused the United States and Israel of deploying the worm.

Authorities said in April a computer virus was detected inside the control systems of Kharg Island - which handles the vast majority of Iran's crude oil exports - but the terminal remained operational.

Communications and Technology Minister Reza Taqipour said last month that Iran needed to develop its own network to ensure the safety of the country's information.

Iran says its nuclear program is entirely peaceful and has refused to halt it despite increasingly draconian U.N. and Western sanctions.

Shaheed is in New York to present his annual report on rights in Iran to the U.N. General Assembly's Third Committee, which focuses on human rights.

His report details how rights activists in Iran face beatings with batons, mock hangings, rape and threats that family members will be raped or killed.

Earlier this week Shaheed, a former Maldives foreign minister, reported that minority religions in Iran continue to face persecution.

Tehran has so far not granted Shaheed access to the country. In its response, the Islamic republic said his overall report was biased, selective and "fails to reflect the actual situation of human rights in Iran."

With election near, sober Romney on foreign policy

(AP) ? Mitt Romney abruptly moderated his foreign policy positions in this week's debate on issues like ending the war in Afghanistan and averting another conflict in Iran, hoping to neutralize one of President Barack Obama's main strengths with the election only two weeks away. But the move toward the political center comes with potential pitfalls.

By abandoning several of his sharpest criticisms of Obama from the past several months, Romney risks upsetting some conservatives and reinforcing the allegation ? levied repeatedly by the president on Monday night ? that his positions lack conviction and leadership.

His aim was to appear sober and serious, a plausible commander in chief, by not engaging in saber-rattling for political points. By narrowing the gap between his positions and those of Obama, he also may have succeeded in giving undecided voters, particularly women, the impression that he would lead a war-weary America into another conflict only reluctantly.

Romney aides said both the tone and substance of their boss' arguments were intentional and that he carried with him into the debate a key piece of advice: Talk about peace.

The overarching goal, they said, was for Romney to look like a suitable commander. After adopting a more assertively militaristic tone to win the GOP nomination amid challenges from more conservative candidates, he sought at all costs to avoid appearing as a warmonger.

"I want to see peace," Romney said in his closing statement.

The shifts in the debate were stark for a candidate who only last week described Obama's foreign policy as "unraveling before our very eyes."

Unconditionally endorsing Obama's 2014 deadline for removing U.S. combat troops from Afghanistan, Romney reversed his opposition to what he had termed a "political" timetable that wasn't necessarily supported by U.S. generals on the ground. And he declared the president's troop surge in Afghanistan a success, after previously accusing Obama with removing too many troops too quickly.

On Iran, Romney stressed that efforts to dissuade the Islamic Republic from developing a nuclear weapon should be "through peaceful and diplomatic means." That came after spending the past year-and-a-half lambasting Obama for failing to levy a credible military threat against Iran and spending too much time trying to rein in Israel's hawkish Prime Minister Benjamin Netanyahu. Monday night, Romney's said Obama's sanctions on Iran were working, calling war a last resort: "It is something one would only consider if all of the other avenues had been tried to their full extent."

And on Syria, Romney modified the argument for deeper involvement he had presented in a foreign policy address earlier this month in Virginia. He argued at that time for a concerted, U.S.-led approach to ensure that Syrian rebels obtain the weapons to defeat the Assad government's "tanks, helicopters and fighter jets." On Monday he adopted Obama's caution by emphasizing the need to ensure arms don't reach "the wrong hands" and stating unequivocally that he wouldn't pursue U.S. military involvement in the conflict.

He expressed his support "entirely" for the administration's escalated drone campaign against terrorist suspects overseas and said the president acted rightly in urging Egyptian strongman Hosni Mubarak to leave power despite three decades of close partnership with the United States.

Obama seized on Romney's shift, rather than his new agreeability.

"We are accustomed to seeing politicians change their position from four years ago," Obama told a Florida rally Tuesday. "We are not accustomed to seeing politicians change their positions from four days ago."

The new focus reflected Romney pitching his case to a changed audience. Having largely satisfied the Republican base over several grueling months of primary campaigning, Romney is now making a last-ditch appeal to women, independents and America's remaining undecided voters as the Nov. 6 election nears. National polls show the president and the challenger running neck and neck, with battleground states such as Ohio, Virginia and Florida ? the scene of Monday's debate ? perhaps proving pivotal.

Romney's move toward the center on foreign policy follows a similar shift he has tried to engineer on domestic issues. In recent weeks, he's softened his rhetoric on immigration, emphasized the importance of regulating Wall Street banks and used a TV ad to emphasize his support for abortion rights in instances of rape and incest and if the mother's health is threatened, all risky positions in a GOP primary battle.

While Romney continues to criticize Obama for military spending cuts, his decision not to visit Israel as president and for failing to challenge Chinese currency manipulation and intellectual property theft, talking up peace was a new wrinkle designed in part to broaden his appeal particularly to women.

During debate preparation, Romney's advisers looked to the first encounter between Ronald Reagan and President Jimmy Carter in 1980. Answering his first question in that debate, Reagan said: "Our first priority must be world peace, and that use of force is always and only a last resort, when everything else has failed."

Aides also urged Romney to follow Reagan in projecting optimism.

"I'm optimistic about our future," Romney said in his closing statement.

The strategy came as a surprise to some conservatives, who expected Romney to challenge Obama directly on some of the biggest foreign policy issues as he had with the economy, unemployment and debt in their first debate earlier this month. Republican commentators lamented Romney's use of "kid gloves" against Obama and his failure to challenge Obama on the Sept. 11 attack on the U.S. Consulate in Benghazi, Libya, that killed a U.S. ambassador and three other Americans.

Libya seemed teed-up for Romney after weeks when he and other Republicans had hammered the administration for possible intelligence and security failures and a shifting message on how it happened.

Asked about the attack with the first question of the debate, Romney instead chose to focus on the larger challenges facing a Middle East in the throes of democratic transition and the continued threat posed by al-Qaida and Islamist extremism. After Obama parried by saying he was investigating the attack and going after the perpetrators, one of Romney's most obvious lines of attack was effectively eliminated from the discussion.

A Romney aide said the Libya issue was already clarified.

"The governor's made clear in many different forums and interviews that he believes that there are more questions than answers at this point," senior adviser Eric Fehrnstrom said. "He's covered that ground."

Aides said the candidate wanted to avoid any traps in territory that he was less familiar with, perhaps explaining the Republican's comfort in allowing the conversation to veer toward education, automobiles, job creation plans and other economic questions.

On many of these issues, Romney has outscored Obama in national polls. On foreign policy, the president has held an advantage. And Romney has struggled to establish his national security credentials after a problematic summer tour overseas that saw him offend his British hosts by questioning their security preparations for the Olympic Games and raise hackles among Palestinians who accused him of racism when he said culture was part of the reason Israelis were more economically successful than they.

Public awareness of the increasing scarcity of water on a global scale has been growing over the last few decades. The main concerns are water quantity and quality; millions of people around the world have infrequent or no access to a source of clean water. This problem is exacerbated by a growing population with ever increasing demands for natural resources. In contrast, here in the USA it is hard to imagine anything but a tap flowing with cool, crisp, potable water. Too often we take water for granted. Through technological advances in the drinking water industry we are seemingly able to meet the majority of demand for water in our own country. At least, we don?t often hear about when our water infrastructure fails.

Outsourcing Enterprise's BYOD Adoption to Improve Chances of ...

Apps in Sphere Pattern - World of Mobile ApplicationsAre you at work? Check the mobile phone you are using. If you are in the Europe, Middle East and Africa (EMEA) region, chances are your company has allowed you to bring your own smart phone to work. The results of a recent survey of the region released by Aruba Networks (NASDAQ: ARUN) suggests that 69% of the organizations in the region have adopted some form of Bring Your Own Device (BYOD)[i]. In research revealed in early September by Global Information, Inc., 65% of global enterprises will allow at least limited BYOD by the end of 2012 and only 11% have no plan to. Does this reflect a global trend? Is there consensus on outsourcing most aspects of an enterprise?s BYOD adoption to improve chances of success and?more importantly?bring sanity to the enterprise mobility strategy?

Enterprises have been wary, but not sluggish, in their response to the BYOD trend driven by the consumerization of technology. There are a number of reasons for enterprises to adopt BYOD. To begin with, it reduces the cost of hardware acquisition and regular upgrades. And second, it improves productivity and makes the enterprise more responsive. These are two reasons CIOs love the trend. But they hate it equally because of the complexities in evolving and implementing a sound strategy around BYOD adoption.Outsourcing Enterprise BYOD

One of the ways to manage the complexity and bring down the pain of BYOD adoption is to outsource the complete process, along with strategy, plan, implementation, onboarding users, support and maintenance. Along the way, outsourcing also improves the ability to build an innovative app ecosystem that is robust, improves employee satisfaction, and delivers enhanced ROI on investments made in mobility.

Top Four Reasons to Outsource the BYOD Initiative

  1. Technological complexity: IT departments love standardization, and mobile technology thrives on evolution and change. No one can accurately predict which will be the dominant operating systems and form factors for mobile devices two years from now (or even 12 months from now). It is difficult for IT to align itself with the needs of mobility. Rather than get stressed, IT should look at outsourcing.
  2. Security: Managing security on mobile networks is complex and requires instant responses. For example, if a mobile device is lost or stolen, enterprise data could be compromised. Should an enterprise ensure it has legal permissions to remotely lock devices that are ?missing? but essentially belong to the employee in order to secure enterprise data? Or should all data be encrypted? Or should access to the data be defined based on networks? These are sticky questions best left to external experts to examine and create a response to.
  3. Device and app usage: As the number of employees bringing their devices grows, networks will need to be continuously monitored for device usage. A user may bring in two or more device to work. Which one has the permissions to log into the corporate network? Device registration and monitoring of applications will become critical. These will need to be assessed for policy compliance with each cycle of device and app change.
  4. Support: When an app changes, how does IT ensure that every user has the new version installed? Today?s regulatory requirements mean that lapses in conformance can prove to be expensive. How will IT manage to support users who are mostly remote even for simple things like changing passwords or upgrading the apps on their devices?

One of the ways to efficiently manage a BYOD roll out is to assess and implement an innovative Mobile Device Management (MDM) application and system. Since the issues involved in selecting the right MDM application can be complex and need to address end-point security, data backup, data encryption, role-based app access, restricted network access, device compliance, device monitoring, auto-freezing device capabilities such as cameras and recorders in certain environments, data and network security, etc., it is best to be innovative and outsource the assessment and implementation. Given the uncertainty involved in mobile usage and application growth as well as compliance requirements, outsourcing can be a comprehensive solution. The CIO then doesn?t have to worry about the selection of MDM applications. Instead, it becomes the outsourcer?s problem to provide capabilities and services based on changing enterprise needs.

When considering a provider to fast track your BYOD initiative using MDM applications, large enterprise should prioritize the following with their outsourcing partner:

  • Setting appropriate policies and processes for devices, networks, and applications and geographies
  • Remote device configuration, monitoring and management
  • Enterprise application, data and network protection/ isolation
  • Multi-platform capabilities
  • Multi-platform support
  • Audit and reporting capabilities
  • Flexibility to integrate with future mobile systems

Success in rolling out the BYOD initiative depends on a sound strategy and the outsourced partner?s capability. But it is equally dependent on the ability of the organization to be innovative and back the initiative with budgets and periodic reassessment of strategy based on business and technology changes.

Built around ?collaborations and friendships with local designers, artists and independent businesses,? each Ace Hotel location is unique and individual to its setting and ?residents.?We recently sat down with Alex Calderwood ? hotelier, ?cultural engineer? and co-founder of Ace Hotel Group ? to find out more about the company?s latest partnership with Reigning Champ, the CYC-owned label specializing in comfortable, well-made basics. Can you introduce yourself?
My name?s Alex and I am a co-founder of Ace Hotel Group.

Ace Hotel has done a great job of bringing an added element to collaboration and user experience. What prompted Ace Hotel to go this route?
We like to work with people who are innovators in their field and create great things or ideas, and thus highlight their talents. Collaborations help satisfy a curiosity we have for how things work and how they?re made. It?s always a rewarding learning process to be able to have a dialogue with a person or a group of people who you genuinely admire.

What sort of brands do you see yourself aligning with most often?
Our alliances and creative unions tend to follow lines of common interests and mutual curiosity. It normally starts with either an existing friendship or a cup of coffee with someone. If it expands beyond that, it does so more or less organically. We think it?s important to let things unfold on their own.

Atelier Ace seems unparalleled in its approach to embracing in-house creatives for all things Ace Hotel. What?s the purpose and strategy of Atelier Ace?
Atelier Ace is the in-house studio for all Ace Hotels. The Atelier team handles cultural programming, marketing, concept and other aspects of interior design, brand relationships, social media, web design, graphic and textual identity. It?s also an incubator for ideas going forward, for both new and existing hotels and whatever else the future may hold. It?s a self-educating unit that works hard and dreams big.

How does Ace Hotel slot it amongst the increasingly competitive boutique hotel landscape? What makes it different from others?
We stand apart in the sense that we?re not locked into a set of parameters ? we have an idiosyncratic and dynamic definition of Ace, that really rests on ideas and not trends. While there?s a commonality of voice at all of our properties, each is inspired by its location ? city, neighborhood, building, community, history, and all the ineffable and immaterial elements that make a ?place.?

To what extent have you considered overseas Ace Hotels?
There are so many cities we?re in love with around the globe ? we?re excited about pursuing interesting buildings and good partnerships, and our ears and hearts are open to the right opportunities.

What factors into your strategy to entering new cities and locations?
The short answer is inspiration. It could be the context of location, the people, the history, the building. But something with a story that we can hopefully weave our own chapter into.

Your most recent collaboration involves Reigning Champ. What?s your working relationship with Craig and the guys over at CYC/RC?
We?ve been friends with Craig for years. In a past life, Craig and I worked on several projects together. Because there?s a history, the process is easy. We know each other, how we work and what each others? tastes are. And Reigning Champ makes beautiful, sturdy things. Ace?s first collaboration with Craig was actually with his other brand, wings + horns. We co-designed a bathrobe inspired by boxing robes that we hang in the rooms at Ace Hotel New York. They?re one of the most popular collaborations we?ve done ? a staple of the guest experience, and a top request on our online shop and from the front desk.

Given the perceived simplicity of Reigning Champ?s bread-and-butter fleece, how did you look to make your mark?
We took Reigning Champ?s classic sportswear and highlighted their construction with color contrast flat-lock stitching, custom labeling, and Ace touches like screen prints and patches inspired by vintage and new ideas.

What can we look forward to in the future from Ace Hotel?
Downtown Los Angeles. We?re opening up a new Ace in downtown LA on the site of the landmark United Artists Theater ? a beautiful example of Gothic Revival architecture built by Mary Pickford, Douglas Fairbanks and company as the flagship of their upstart production company. It?s a place that?s teeming with history and inspiration and part of a broader project to revitalize downtown LA. We?re proud to be a part of it.

Difficulty breathing, chest pain, and cough may sound like symptoms of a heart attack; however, new research shows that these are the key symptoms for pulmonary embolism (PE), a potentially fatal blockage in the lung. A research team from Saint Vincent's Medical Center in Bridgeport, Connecticut, retrospectively reviewed the clinical features, risk factors, and ECG findings in 334 patients with confirmed PE. Results showed that dyspnea or difficulty breathing, chest pain, and cough were present in 72%, 38%, and 19% of the patients, respectively, and dyspnea was the only presenting symptom in 29%. Cancer was the most common risk factor present in 27%, followed by prior history of deep vein thrombosis or PE, immobilization, and surgery in 19%, 15%, and 15%, respectively. This study was presented during CHEST 2012, the annual meeting of the American College of Chest Physicians, held October 20 25, in Atlanta, Georgia.

? Gerald Green scored 11 of his 18 points in the fourth quarter to help the Indiana Pacers hold off the Memphis Grizzlies 83-80 in a preseason game Saturday night.

Roy Hibbert had 14 points and 10 rebounds, Paul George scored 14 points, Ian Mahinmi had 13 and Tyler Hansbrough added eight points and 13 rebounds for the Pacers.

Memphis had a chance to tie, but Rudy Gay missed a 3-pointer at the buzzer. He finished with six points on 3-for-17 shooting.

Zach Randolph scored 15 points, Marc Gasol added 13 points.

Indiana won without three starters. George Hill was out with a hip pointer, Danny Granger sat out with a sore left knee and David West did not play.

Amid ongoing economic crisis, EU celebrates 'Single Market Week'

The EU is celebrating the 20th anniversary of the single market this week, in part to point out that despite the economic crisis wracking Europe, the union has brought positive changes too.

News reports about the European Union nowadays do not give much reason for celebration. Greece is on the brink of economic collapse, other European countries are also in severe economic troubles, and shrinking solidarity is going hand-in-hand with reviving stereotypes. Yes, the European Union won the Nobel Peace Prize last week, but this news was quickly met with cynical comments.

Nevertheless, the EU today kicked off a week of celebrations, commemorating the 20th anniversary of the single market, which allows Europeans and their goods to move around all 27 member states without borders or barriers. The Single Market Week encompasses events all around Europe, with various ?opportunities to discuss the main achievements of the Single Market.? Some of these include ?cheaper calls abroad,? ?safer toys,? and ?more rights for travelers,? according to documents handed out to attendees of the launch event of the Single Market Week at the European Parliament in Brussels.

The celebration comes at a time when citizens' trust in the European Union is at an all-time low, according to the most recent survey by Eurobarometer. Only 31 percent of EU citizens say they trust the European Union (mind you: they trust their national governments even less). Also, 28 percent have a flat-out negative view of the EU ? almost double the figure of six years ago.

According to some of the speakers today, the European Union doesn't always receive the credit it deserves. ?Citizens don't attribute their cheaper mobile phone bills to the single market,? said Malcolm Harbour, a member of the European Parliament for the British Conservative party, during a meeting with journalists. ?Sometimes we forget how much has been achieved. The free movement of people, students studying abroad ? citizens take that for granted.?

Mr. Harbour has a point. I arrived here in Brussels yesterday from the Netherlands, without realizing that my train didn't have to stop at the border. The only reason I brought my passport was to show it at the security check of the European Parliament. And it is not just free movement of journalists and other Europeans. If I want, I can buy as many Belgian waffles as I want without having to declare them at the border.

As European Commissioner Michel Barnier said: ?Our lives have been made easier.? But as with most advancements, we quickly take them for granted. So how to make the people more aware of these things? Mr. Barnier's answer was simple: ?We have to talk about it.? And that's what EU representatives will be doing this week.

There have probably been times when we all wanted to howl at the moon but let our inhibitions (or fear of being arrested) get in the way. National Mincemeat Day

Most people have heard of mincemeat pies, but very few actually know what they are. Historically they were made with chopped liver, minced meat, boiled eggs, dried fruit and spices ? yum! Through the ages the meat was replaced with suet (or fat), and today they generally contain a preserve containing apples, dried fruits, spices, and either suet or vegetable shortening.

Well, today is "National Mincemeat Day," so if you're ever going to take the plunge, now's the time. Since you're not likely to find a good variety of mincemeat baked goods at your local grocery, here are some interesting recipes from Yahoo! Shine:

Mule Day

October 26 is "Mule Day," and marks the anniversary of the arrival of a very special Spanish donkey to the United States in 1785. The donkey was a gift to George Washington from King Charles III of Spain.

Washington used the donkey to breed with his prize Virginia mares and started a herd of "super mules." By 1799 there were 57 new mules at Mt. Vernon. Many of the finest mules in America today came from this prestigious lineage.

CEA officially brands 4K as Ultra HD, gets ready for a flood of new displays at CES

Now that HDTV is "the new normal" according to Nielsen (its most recent stats say more than 75 percent of US households have one) then naturally, it's time to upgrade to 4K. This week the Consumer Electronics Association officially dubbed such screens -- with characteristics including at least eight million active pixels, and 3,840 x 2,160 resolution, among other things -- Ultra High-Definition, or Ultra HD in order to help educate consumers about the new tech. The ITU already laid down its spec recommendations for Ultra High Definition TV so the industry should be able to move forward in unison pushing super high-res displays across the land. Of course we did say "should," and Sony is already informing media outlets that it plans to market its 4K products as "4K UHD." Whatever it's called, we saw 84-inch screens from multiple manufacturers announced recently, and with the CEA's announcement we're penciling in a few more pixel-dense models for the big Las Vegas show in January.

The Supremes and Expectations of Privacy on Workplace Computers

This morning, by 6 to 1, the SCC dealt with pornography on a work-issued computer and whether an employee had any reasonable expectation of privacy. The majority of the court set asise the Ontario Court of Appeal's order in R. v. Cole, to exclude the evidence on the basis that it was obatined in breach of ss. 8 and 24(2) of the Canadian Charter of Rights and Freedoms. Abella J. would have continued the exclusion. A new trial will be held in any event.

Here is the headnote:

The accused, a high-school teacher, was charged with possession of child pornography and unauthorized use of a computer. He was permitted to use his work-issued laptop computer for incidental personal purposes which he did. While performing maintenance activities, a technician found on the accused?s laptop a hidden folder containing nude and partially nude photographs of an underage female student. The technician notified the principal, and copied the photographs to a compact disc. The principal seized the laptop, and school board technicians copied the temporary Internet files onto a second disc. The laptop and both discs were handed over to the police, who without a warrant reviewed their contents and then created a mirror image of the hard drive for forensic purposes. The trial judge excluded all of the computer material pursuant to ss. 8 and 24(2) of the Canadian Charter of Rights and Freedoms. The summary conviction appeal court reversed the decision, finding that there was no s. 8 breach. The Court of Appeal for Ontario set aside that decision and excluded the disc containing the temporary Internet files, the laptop and the mirror image of its hard drive. The disc containing the photographs of the student was found to be legally obtained and therefore admissible. As the trial judge had wrongly excluded this evidence, the Court of Appeal ordered a new trial.

Held (Abella J.dissenting): The appeal should be allowed. The exclusionary order of the Court of Appeal is set aside and the order of a new trial is affirmed.

Per McLachlin C.J., and LeBel, Fish, Rothstein, Cromwell and Moldaver JJ.: Computers that are reasonably used for personal purposes ? whether found in the workplace or the home ? contain information that is meaningful, intimate, and touching on the user?s biographical core. Canadians may therefore reasonably expect privacy in the information contained on these computers, at least where personal use is permitted or reasonably expected. Ownership of property is a relevant consideration, but is not determinative. Workplace policies are also not determinative of a person?s reasonable expectation of privacy. Whatever the policies state, one must consider the totality of the circumstances in order to determine whether privacy is a reasonable expectation in the particular situation. While workplace policies and practices may diminish an individual?s expectation of privacy in a work computer, these sorts of operational realities do not in themselves remove the expectation entirely. A reasonable though diminished expectation of privacy is nonetheless a reasonable expectation of privacy, protected by s. 8 of the Charter. Accordingly, it is subject to state intrusion only under the authority of a reasonable law.

The police in this case infringed the accused?s rights under s. 8 of the Charter. The accused?s personal use of his work-issued laptop generated information that is meaningful, intimate, and organically connected to his biographical core. Pulling in the other direction are the ownership of the laptop by the school board, the workplace policies and practices, and the technology in place at the school. These considerations diminished the accused?s privacy interest in his laptop, at least in comparison to a personal computer, but they did not eliminate it entirely. On balance, the totality of the circumstances support the objective reasonableness of the accused?s subjective expectation of privacy. While the principal had a statutory duty to maintain a safe school environment, and, by necessary implication, a reasonable power to seize and search a school-board issued laptop, the lawful authority of the accused?s employer to seize and search the laptop did not furnish the police with the same power. Furthermore, a third party cannot validly consent to a search or otherwise waive a constitutional protection on behalf of another. The school board was legally entitled to inform the police of its discovery of contraband on the laptop. This would doubtless have permitted the police to obtain a warrant to search the computer for the contraband. But receipt of the computer from the school board did not afford the police warrantless access to the personal information contained within it. This information remained subject, at all relevant times, to the accused?s reasonable and subsisting expectation of privacy.

Unconstitutionally obtained evidence should be excluded under s. 24(2) if, considering all of the circumstances, its admission would bring the administration of justice into disrepute. The conduct of the police officer in this case was not an egregious breach of the Charter. While the police officer did attach great importance to the school board?s ownership of the laptop, he did not do so to the exclusion of other considerations. The officer sincerely, though erroneously, considered the accused?s Charter interests. Further, the officer had reasonable and probable grounds to obtain a warrant. Had he complied with the applicable constitutional requirements, the evidence would necessarily have been discovered. Finally, the evidence is highly reliable and probative physical evidence. The exclusion of the material would have a marked negative impact on the truth-seeking function of the criminal trial process. The admission of the evidence would not bring the administration of justice into disrepute and therefore the evidence should not be excluded.

Generally speaking, the decision to exclude evidence under s. 24(2) should be final. In very limited circumstances however, a material change of circumstances may justify a trial judge to revisit an exclusionary order. In this case, the Court of Appeal invited the trial judge to re-assess the admissibility of the temporary Internet files disc if the evidence becomes important to the truth-seeking function as the trial unfolds. Unconstitutionally obtained evidence, once excluded, will not become admissible simply because the Crown cannot otherwise satisfy its burden to prove the guilt of the accused beyond a reasonable doubt.

Per Abella J. (dissenting): While it is agreed that there has been a Charter breach, the evidence in this case should be excluded under s. 24(2). The Charter-infringing conduct in this case was serious in its disregard for central and well-established Charter standards. The police officer had years of experience in investigating cyber-crime and was expected to follow established Charterjurisprudence. Further, the police officer?s exclusive reliance on ownership to determine whether a warrant was required, was unreasonable and contradicted a finding of good faith for the purposes of s. 24(2). There were also no exigent circumstances or other legitimate reasons preventing the police from getting a warrant. The decision not to get a warrant mandates in favour of exclusion.

The impact of the breach on the accused?s Charter-protected interests, even assuming that his reasonable expectation of privacy was reduced because it was a workplace computer, was significant given the extent of the intrusion into his privacy. The warrantless search and seizure in this case included the entire contents of the accused?s computer. It had no restrictions as to scope. The extent of the search of the accused?s hard drive and browsing history was significant and weighs in favour of exclusion.

Finally, while the evidence in this case is reliable, its importance to the prosecution?s case is at best speculative given that the pornographic photographs themselves were admitted.

Balancing these factors, and in light of the deference owed to trial judges in applying s. 24(2), the evidence should be excluded.

Just a few days after writer Raymond Carver?s death, his wife, poet Tess Gallagher, called Bob Stewart at home. He was expecting to hear from her, expecting her to cancel. Her scheduled appearance at the Midwest Poets Series, which Stewart directs, was only two weeks away, and when he heard the news about Carver, he just knew what she?d say. ?This is her way of saying she?s not going to make it,? he thought as soon as he heard her voice on the other end of the line.But Gallagher surprised him. ?She said, ?No, I absolutely want to assure you I?m going to come,??? Stewart said. ?Because she wanted to celebrate Ray Carver?s life.?Two weeks later, Gallagher arrived at Rockhurst University and held the stage for more than an hour and a half. She read not just her own work but also brought out poems by Carver no one had seen before.?We had one of the most extraordinary evenings in memory,? Stewart said. That?s saying a lot for a program that in its first 29 years has brought to Kansas City 14 Pulitzer Prize winners, 10 U.S. poets laureate, two Missouri poets laureate and one winner of the Nobel Prize in literature. The series, which Stewart founded in 1983, will kick off its 30th anniversary year on Thursday with a 15th Pulitzer winner, Tracy K. Smith, who won the 2012 prize last spring. The reading is just one highlight of a season that once again celebrates the global range and influence of the written word.The Midwest Poets Series has become a cultural institution in the community and made a name for Kansas City on the national and international poetry scene.?It?s the kind of place where poets would like to read because we have nothing if not authenticity,? said Michelle Boisseau, a Kansas City poet and creative writing colleague of Stewart?s at the University of Missouri-Kansas City. Boisseau read at the series last year. ?When I got up on stage I felt so much desire to hear me read. It?s incredibly energizing to read to that audience.?Stewart says this year?s poets can be seen as a microcosm of the series as a whole. Rounding out the schedule are Valzhyna Mort on Nov. 29, Mark Doty on Jan. 31 and Australia?s Les Murray on March 21. ?Bob took special care in choosing the slate of poets,? said Cynthia Cartwright, director of the Center for Arts and Letters at Rockhurst. ?He is very careful about constructing a season where there are both male and female poets, all sorts of ethnic backgrounds, national reputations and international reputations.?Smith is African-American, and Mort, ?a true international voice,? grew up in Belarus before she moved to the U.S. Stewart called Doty ?one of the premier figures in contemporary American poetry.? Murray, who lives in New South Wales, Australia, is renowned worldwide.Murray has published 12 books of poetry, translated into 10 languages. Doty, with eight books of poems and four books of prose, is only the second poet to make a repeat appearance. Mort and Smith are making names for themselves early in their careers; Smith has three books, and Mort recently published her second American book. ?The whole series represents what we?ve been trying to do all these years,? Stewart said.Doty and Smith also reflect Stewart?s method of choosing poets, which involves a little acute observation, a little intuition and a little luck.?Every time I turn around lately, I?m discovering a poem by Mark Doty, or my students are telling me things they?re reading by Mark Doty that they?re enthusiastic about,? he said. ?There?s just too many intersections of interest that I can?t ignore.?Similarly, Kansas City writer Whitney Terrell mentioned Smith?s name to Stewart a couple of years ago, and when she won the Pulitzer earlier this year, Stewart knew the time was right to invite her.?So often it happens, where I?m kind of already interested in (a poet), and there will be little things that come up, sort of like the universe is telling me that now is the time to bring this person to Kansas City,? Stewart said. ?I look for where the energy is.? Attracting poets of Murray?s international stature sets the Midwest Poets Series apart from other cultural institutions in the country, Boisseau said. Someone like Murray, who often reads in major cities like New York, would never have a chance to visit Kansas City otherwise, she said.And when major poets do come to read, they find it a rewarding experience. People are there to see the poet and are not likely to approach him or her with manuscript in tow, just trying to further their own careers.Stewart said many of the poets he keeps in touch with have fond memories of the series and even ask if they can come back. The Midwest Poets Series puts Kansas City on the map for people who otherwise may never see or think about it. ?In literary terms, on a national scale, I don?t think it can be doubted that a lot of major writers in the country identify with Kansas City now, and they wouldn?t have without this here,? Stewart said.When she arrived at Rockhurst more than 20 years ago, Cartwright was initially surprised by the poetry series? popularity.?Where are these readings held, in a phone booth?? she wondered. ?Who comes out to them??She estimated that the series as a whole now draws 900 people a year, many of them frequent attendees. For the last 10 to 15 years, the series has been in Rockhurst?s Mabee Theater, which seats 300.?It?s not uncommon to have standing room only,? said Cartwright, who applauded the shared experience of hearing poetry in public. Former poets laureate Billy Collins and W.S. Merwin both drew crowds of almost 1,000 for their readings, which were in the campus gymnasium. Merwin?s reading was especially memorable for Stewart. He remembers Boisseau sitting in the front row, listening with rapt attention. ?Merwin got done reading; everybody applauded, and Michelle just sat there,? he said. ?Finally she stood up and she says, ?I feel like somebody has just been throwing flowers on me for an hour.????I remember feeling as if all the cows were surrounding the manger,? Boisseau said. ?He was glowing like some kind of emanation.?But even a sparsely attended reading can have a big impact.In 1989, Stewart brought Joseph Langland, a poet who?d grown up in Iowa in a community of Norwegian immigrants. He recalls maybe 15 people in the audience. ?I remember sitting in the front row and thinking, ?I don?t care who?s here, I?m here,??? Stewart said. ?I was completely thrilled to sit there and listen to Joe Langland read his poems.?Because, in the end, poetry is a personal experience. Stewart says it ultimately doesn?t matter how many people come to a reading. If a reading changes one person?s life, he said, it?s extraordinary.?People get uplifted, they?re entertained in a way that?s a little deeper, more powerful than we?re used to with mass media entertainment,? he said. ?I think it changes people?s thinking about who poets are and what they?re about.?Being present at the Midwest Poets Series is inspirational, Boisseau said.?When you?re in the salt spray of language,? she said, ?then you say, ?I want to go on my own voyage, I want to build my own ship.? And that?s why we bring people to town.?
